red750
I received this today by email. Obituary Today we mourn the passing of a beloved old friend, Common Sense, who has been with us for many years. No one knows for sure how old he was, since his birth records were long ago lost in bureaucratic red tape. He will be remembered as having cultivated such valuable lessons as: Knowing when to come in out of the rain. Why the early bird gets the worm. Life isn't always fair. And maybe it was my fault. Common Sense lived by simple, sound financial policies (don't spend more than you earn) and reliable strategies (adults, not children, are in charge). His health began to deteriorate rapidly when well-intentioned but overbearing regulations were set in place. Reports of a 6-year-old boy charged with sexual harassment for kissing a classmate; teens suspended from school for using mouthwash after lunch; and a teacher fired for reprimanding an unruly student, only worsened his condition. Common Sense lost ground when parents attacked teachers for doing the job that they themselves had failed to do in disciplining their unruly children. It declined even further when schools were required to get parental consent to administer sun lotion or an aspirin to a student; but could not inform parents when a student became pregnant and wanted to have an abortion. Common Sense lost the will to live as the churches became businesses; and criminals received better treatment than their victims. Common Sense took a beating when you couldn't defend yourself from a burglar in your own home and the burglar could sue you for assault. Common Sense finally gave up the will to live, after a woman failed to realize that a steaming cup of coffee was hot. She spilled a little in her lap and was promptly awarded a huge settlement. Common Sense was preceded in death, by his parents, Truth and Trust, by his wife, Discretion, by his daughter, Responsibility, and by his son, Reason. He is survived by his 5 stepbrothers. I Know My Rights I Want It Now Someone Else Is To Blame I'm A Victim Pay me for Doing Nothing Not many attended his funeral because, so few realized he was gone. If you still remember him, pass this on. If not, join the majority and do nothing.
red750
Further evidence of the demise of Common Sense, particularly in - where else? - America. On Sunday night's 60 Minutes, they had a story about a number of instances where US courts had granted access or custody of a child resulting from rape --- to the rapist. Imagine your daughter being raped and falling pregnant, then have to hand over her child every couple of weeks to the rapist, who claimed, and was granted, parental rights, for unsupervised access. RIP Common Sense.

Bruce Tuncks
On the face of it you are right red, but I have to point out that we don't know all the facts of those cases. An example would be in sentencing. Most people who just read a summary story think that the sentence is too lenient. But those who know all the details think its too severe. Well that's what I have read and it seems reasonable. Take the rapist story... if a 17.1 year old has sex with a 16.9 year-old, that is rape in some jurisdictions. Mind you, I reckon you are quite right about creeping political correctness often leading to insane outcomes.
farri
Merriam Webster Dictionary. Definition of common sense : sound and prudent judgment based on a simple perception of the situation or facts The problem with common sense is that not everyone`s "perception" of a situation is the same.
facthunter
Watch your sources. It's newsworthy to make out these cases of misplaced logic.or outrageous failure of Justice. Many things do NOT work as intended. Justice is not available by and large to the less well off because there's NO money in it and the rich, who have the major say in MOST things don't see it helping THEM, to do anything to change it..Look at the "familiar" Lawyers who work for all the BIG Crims. Why? Because it PAYS. Nothing to do with JUSTICE. COMMON Sense is a Misnomer, particular in OUR times as there's great efforts made to misinform people Again, because there's BIG money in it.Nev Edited July 19, 2020 by facthunter elaborate. 2
old man emu
How common is the use of the phrase, "I only do what is best for my client" amongst legal eagles. with scant concern for doing what is the spirit of the Law?
facthunter
"Don't blame me . I'm only the hired Gun.". That's direct from one who I accused of dirty play, in not having files ready, so an adjournment and extra costs. A common tactic that a good judge would be on to straight away.
