News just to hand, has Clive Palmer making the startling claim, that his solicitor (Sam Iskander) has stolen possibly up to $30M from Palmers private company Mineralogy, between 2016 and July 2025.

 

Palmers lawyer has issued an injunction to seize a large amount of the solicitors assets, and Iskander has handed in his solicitors licence to practice law. I guess this step is due to the allegations and injunction.

 

Iskander has not been officially charged with any offences at this time, which seems unusual to me. It appears that Palmers move is simply one designed to stop his lawyer from spending any of his money or disposing of assets, until Palmer can actually prove he's been robbed.

The whole setup seems strange to me, I thought anytime there was criminal wrongdoing, and you could provide some evidence, that Police moved in and charged the defendant. Maybe they have different rules for lawyers??

The injunction will definitely be to stop the flight of cash/assets away from the jurisdiction of the court. Remember, at this stage, the court has only found prima facie evidence of the crimes alleged and I would not be surprised if there are some shady deals that have gone on in the background that may or may not come to light. I don't know how it works in Aus, but in the UK, a lawyer wouldn't surrender their certificate. It would be suspended by the relevant regulator/industry association responsible, pending investigation. A lawyer who surrenders their certificate is effectively admitting guilt. I would expect it to be the same, unless what was meant by surrendering or handing in their certificate was actually a suspension, and as a result the lawyer had to hand over their certificate. 

 

It sounds like it was being done over a long period and the lawyer, Iskander, must have thought it was water tight. Otherwise, you would have a bolt hole in Spain, and have used property to layer the proceeds and then convert it to cash and invest it using some offshore vehicle that is untouchable byy Australia. Then, when you hear the sirens, you head off to the bolt hole and enjoy Sangria and Chorizo for the rest of your life

The legislation in Qld is the Legal Profession Act 2007 (as amended). Suspension or cancellation of a lawyers certificate to practice appears to start at Sect 59, and it seems the regulator initially sends a "show cause" notice to the offender stating the reason/s why they should be suspended, or surrender their certificate.

As Sam Iskander surrendered his certificate, it appears he must have weak grounds to refute the allegations, or one would think he would've taken legal action to stop the action, by showing he had cause to stop it.

 

My personal opinion is, I think that anyone who works for Clive Palmer must have dubious ethics, anyway.

If he sues everyone who say he's a dickhead, the courts will be jammed up for the next thousand years.

Yeah, but he has the power to cut a lot of government work from these firms - and he has threatened them with just that. It's not just his personal wealth that he has the levers to.

He's worth a reported $4B. He wouldn't miss $30M, it's small change to him. He paid $15M for a boat given as a gift to his daughter.

C'mon fellas.. You don't get like that withoout watching every penny..

 

Also, I am guessing it is a bit about pride. He comes across to me, at least, as an egotistical SoB.
